H-4 EAD renewal
2 min read
Certain spouses of H-1B workers in H-4 status may apply for an Employment Authorization Document (EAD) under rules published by USCIS. This page covers renewal planning at a high level.
Why renewal timing matters
An EAD lists an expiration date. You may not work based on that EAD after it expires unless another work authorization applies. Gaps in renewal can mean a gap in lawful employment, so most people plan filings well before the card expires.
Form I-765
Renewal is typically filed on Form I-765 with the correct category code and fee (or fee exemption if applicable). USCIS publishes editions, instructions, and supporting document lists on uscis.gov/i-765. Use the edition and checklist current at the time you file.
When to file
Many attorneys recommend filing a renewal several months before expiration because processing times vary by service center and can change. Some filers have benefited from automatic extension provisions in specific circumstances; those rules are detailed in federal regulations and USCIS policy and are not summarized here as legal guidance.
Ties to the principal H-1B
H-4 EAD eligibility is generally linked to the principal worker maintaining valid H-1B status (and other requirements USCIS specifies). If the H-1B case ends or changes materially, work authorization can be affected; coordinate with your employer's immigration counsel.
